I don't get why we're acting like Gainax has already dissolved. None of the sources state this and bankruptcy isn't an automatic dissolution. There have been cases before of organizations going bankrupt and still existing or being bought up and made a subsidiary. We should wait for news of dissolution first. I know bankrupt ≠ defunct, but it's hard to differentiate the two. Their bankruptcy was filed on the 29th of May, and nobody was aware of it until it came to light a few days ago, and since Khara is transferring whatever IPs Gainax had left, as well as the aforementioned notice they put up in place of their main website, they might've been dissolved on the same day their bankruptcy came to light, but someone should correct me on this, since I'm not very knowledgeable in how bankruptcies work. In Japan, when a company files for bankruptcy, it ceases to operate and its assets are liquidated. Therefore, it is not necessary to wait for news of a dissolution, since that will happen at the end of the process and the company will not return. Also, in the US, companies can emerge from bankruptcy, but in Japan, they don't, so past tense is appropriate here. Quetstar (talk) 01:16, 12 June 2024 (UTC)[reply]
@Quetstar Checked the law. If the translation I found is correct, under Article 35 of the Bankruptcy Act, "A juridical person that is dissolved by reason of an order of commencement of bankruptcy proceedings under the provisions of other Acts or a dissolved juridical person that has received an order of commencement of bankruptcy proceedings shall be deemed to remain in existence to the extent of the purpose of liquidation through bankruptcy proceedings until the bankruptcy proceedings are closed" so it will be defunct but it has not yet happened. On WP, Japanese companies that have filed for bankruptcy are considered defunct the moment they file, like Cing, AlphaDream or Arms for example. Also, dissolution is almost never reported and is the usual conclusion in such cases, meaning that if we wait, the article will stay as is for a long time.
